These Terms & Conditions govern your use of this website and any services you engage HER Business Websites ("we", "our", "us") to provide, including website design, build, e-commerce, landing pages, care plans, hosting and domains. By using the site or engaging us, you agree to these terms. Specific project terms are set out in your signed proposal or statement of work, which take precedence over anything below in the event of a conflict.
Use of this website
- The site is provided for general information and to submit enquiries.
- You agree not to misuse the site, attempt to gain unauthorised access, or interfere with its operation.
- We may update, suspend or withdraw parts of the site at any time.
Our services
Our services include website design, front-end and CMS build, e-commerce, landing pages, ongoing care plans, hosting and domain management. Scope, deliverables and timelines for each engagement are set out in the proposal or statement of work you sign.
Enquiries and quotations
Quotations are based on the information provided in your Discovery submission and any subsequent conversations. A quotation is valid for 30 days unless stated otherwise and does not create a binding contract until both parties sign the proposal.
Fees, invoicing and late payment
- Project fees, deposits and payment schedules are set out in the proposal.
- A non-refundable deposit is typically due before work begins.
- Recurring care plans, hosting and domain renewals are billed in advance and continue until cancelled in line with the plan terms.
- We reserve the right to charge statutory interest on late payments under the Late Payment of Commercial Debts (Interest) Act 1998.
Client responsibilities
You agree to provide, in a timely way:
- Content, copy, images, brand assets and access credentials we need to deliver the project.
- Feedback and approvals at agreed milestones.
- Confirmation that you own or have the right to use any material you supply.
Intellectual property
- You retain ownership of the content and brand assets you supply.
- On full payment of project fees, you receive a licence to use the final delivered website for your business.
- We retain ownership of our underlying frameworks, tools, code libraries and design systems, including reusable components used across client sites.
- Third-party assets (fonts, stock imagery, plugins) remain subject to their own licences.
Care plans, hosting and domains
- Care plans cover the specific tasks listed in the plan tier you subscribe to — additional work is quoted separately.
- Hosting is provided on shared infrastructure with reasonable-endeavours uptime; scheduled maintenance may temporarily interrupt service.
- Domains registered on your behalf are registered in your name where possible; renewal responsibility is set out in the plan.
- You may cancel a rolling care plan with 30 days' written notice.
Warranties
We will provide the services with reasonable care and skill. Beyond that, and to the fullest extent permitted by law, the site and our services are provided "as is" without further warranties.
Liability
Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence or for fraud. Subject to that, our total liability arising out of or in connection with any engagement is limited to the fees paid to us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect or consequential loss, loss of profit, or loss of business.
Confidentiality
Each party will keep the other's confidential information confidential and use it only for the purposes of the engagement.
Data protection
We process personal data in line with our Privacy Policy. Where we host or maintain a client site we may act as a processor for personal data you control; a data-processing schedule is available on request.
Termination
Either party may terminate a project engagement on written notice if the other materially breaches these terms and fails to remedy the breach within 14 days. Fees for work already carried out remain payable and non-refundable.
Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of them.
